Screenplay Evaluation Terms and Conditions

I understand that in order to submit my screenplay for evaluation that I must be at least 18 years old (or 21, if required by the laws in my state). If I am younger than 18 (or 21, if required by the laws in my state), I understand that my parent or legal guardian must fill out the online form to submit my screenplay for evaluation.

I understand that having my screenplay evaluated does not guarantee me success as a screenwriter – or in the film industry as a whole. I release and hold harmless Running On Empty Productions, LLC, its managing members, and its affiliates from any such claim of guaranteed success.

I understand that my personal information will not be sold or given to any third party businesses, persons, or entities, deriving from the Running On Empty Productions, LLC website. I release and hold harmless Running On Empty Productions, LLC, its managing members, and its affiliates from any and all such claims relating to the sale of my personal information.

I understand that I must have a U.S. Copyright and a Writers Guild registration on my screenplay/script before submitting it to Running On Empty Productions, LLC. I understand that the copyright can be pending, as long as I’ve sent it to the U.S. Copyright office one week prior to sending Running On Empty Productions, LLC a copy.

I understand that as the submitting screenwriter that I must be the only author of the script/screenplay submission. If that is not the case, I understand that I must list all screenwriters of the submitted material to be evaluated.

I understand that as the submitting screenwriter, I must create a written agreement between myself and all other screenwriters of the material, stating that all agree to submit the screenplay for evaluation to Running On Empty Productions, LLC. This must be signed and dated by all screenwriters 18 and older, or the parents of those under 18, or 21, depending on the state that I reside in.

I understand that if I send Running On Empty Productions, LLC an unsolicited and/or unmarked package without the registration evaluation coupon attached to the back of the envelope or package OR without the PayPal Receipt Number written legibly on the back of the envelope or package, that the package/envelope will be returned to me, the sender, UNOPENED or DISCARDED at Running On Empty Productions, LLC’s discretion.

Refunds

I understand that refunds, reimbursements, and discounts will not be granted under any circumstances, including but not limited to: if I decide I don’t like my evaluator; if I don’t like the service that I’ve been given by Running On Empty Productions, LLC and its representatives; if I disagree with the marks and suggested changes that have been done on my screenplay evaluation; and if after the completion of the entire evaluation process, I still do not sell, option, or produce my screenplay or script from the time of completion of the evaluation and through eternity. I understand that having my screenplay evaluated by Running On Empty Productions, LLC or any company does not guarantee that I will sell, option, or have my screenplay produced, nor does it secure a literary agent for me.

I agree to release and hold harmless Running On Empty Productions, LLC, its managing members, contractors, licensees, affiliates of any and all liabilities, civil or criminal, stemming from the submission of my screenplay material to be evaluated. I understand that my screenplay will be kept in the utmost confidentiality within Running On Empty Productions, LLC, its managing members, its contractors, its licensees, its affiliates, and the writer(s) of the screenplay. However, I do understand that some ideas within the film market/industry are similar, and that my idea may already be in development, pre-production, production, post production, and distribution, and that I release and hold harmless Running On Empty Productions, LLC, its managing members, its contractors, its licensees, and its affiliates from any and all liabilities or claims regarding my screenplay idea already being in the public domain and/or circulation.

The Evaluation Analysis Phone Call

I understand that I must be at least 18 years old (or 21, if required by the laws in my state) to speak with my evaluator over the phone for the one-on-one evaluation analysis segment of the screenplay evaluation process. If I, or one of the writers is under 18 (or 21 if required by the laws in my state), I must have my parent or legal guardian, or the parent or legal guardian of one of my writers on the screenplay if they’re under 18 years old (or 21, if required by the laws in my state), submit a simple letter of permission, signed, dated and notarized to Running On Empty Productions, LLC, stating that they grant permission for their child to participate in the analysis with a Running On Empty Productions, LLC representative. I release and hold harmless Running On Empty Productions, LLC, its managing members, its contractors, its representative, its licensees, and its affiliates from any and all liabilities stemming from the over the phone one-on-one call [or conference call, if there is more than one writer, if the submitting writer chooses this option.] I understand that any and all liabilities includes: the cost of long distance phone service and/or cell phone minutes during an evaluation analysis over the telephone, or any and all circumstances beyond Running On Empty Productions, LLC’s, its representatives, its managing members, its contractors, its licensees, and its affiliates control.

I understand that I must thoroughly read, understand, and accept the requirements for submitting a screenplay for evaluation, and that I must read, understand, and accept the terms and conditions. In doing so, I understand that I am responsible and liable for any falsifying of any and all information submitted via the Running On Empty Productions, LLC’s website or any information sent by me via the mail to Running On Empty Productions, LLC, and that I release and hold harmless Running On Empty Productions, LLC, its managing members, its contractors, its licensees, and its affiliates from any and all liabilities – civil and criminal – stemming from the entire submission evaluation process, including but not limited to: placing my personal information online; uploading my script to the Running On Empty Productions, LLC website; sending information, including the screenplay/script via mail; and participating in the one-on-one evaluation analysis process. I understand that Running On Empty Productions, LLC reserves the right to make changes to its terms and conditions at its discretion without notice to me, and that I will be subject to those revisions.
